ACKNOWLEDGEMENT, RELEASE AND WAIVER OF LIABILITY LISA SIMON LLC, DBA POND VIEW FARM 208 CR 620, West Salem, OH 44287 ACKNOWLEDGMENT OF RISKS I, the undersigned, understand and acknowledge that visiting Pond View Farm, an agritourism venue and working alpaca farm, involves inherent risks. These risks include, but are not limited to: • Injury from interacting with alpacas, such as bites, kicks, spitting, or trampling, as alpacas are unpredictable animals. • Slips, trips, or falls due to uneven terrain, natural hazards, or farm equipment. • Allergic reactions to animals, hay, dust, or other environmental factors. • Property damage or loss caused by animals or farm conditions. • Illness or injury from exposure to animals, including zoonotic diseases. • Risks associated with other farm activities, such as feeding animals, walking in pastures, or using recreational areas. I understand that alpacas are domestic animals with unpredictable behaviors and that Pond View Farm cannot guarantee my safety or the safety of my property. ASSUMPTION OF RISK By entering the premises of Pond View Farm, I voluntarily assume all risks associated with my participation in farm activities, including but not limited to petting, feeding, or walking among alpacas, and any other activities offered on the farm. I acknowledge that I am responsible for my own safety and the safety of any minors under my supervision. RELEASE AND WAIVER OF LIABILITY In consideration of being permitted to enter Pond View Farm and participate in its activities, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby: 1. Release, Waive, and Discharge Pond View Farm, its owners, operators, employees, volunteers, agents, successors, and assigns (collectively, the “Released Parties”) from any and all claims, demands, damages, expenses, lawsuits, or liabilities of any kind, whether known or unknown, arising from my participation in farm activities, including but not limited to personal injury, death, property damage, or loss, even if caused by the negligence of the Released Parties. 2. Indemnify and Hold Harmless the Released Parties from any claims, costs, or liabilities, including attorney’s fees, arising from my actions or the actions of any minors under my supervision while on the farm premises. PHOTO AND VIDEO RELEASE I grant Pond View Farm permission to photograph or video me (or my minor child) during my visit and to use such images or videos for promotional, educational, or other lawful purposes without compensation or further permission. SAFETY RULES AND COMPLIANCE I agree to follow all posted signs, verbal instructions, and written rules provided by Pond View Farm, including but not limited to: • Staying with the tour leader and not wandering unaccompanied on the farm. • Refraining from touching alpacas’ heads or engaging in behavior that may stress the animals. • Supervising minors at all times to ensure their safety and compliance with farm rules. Failure to follow these rules may result in my removal from the premises without refund. HEALTH AND MEDICAL ACKNOWLEDGMENT I certify that I (and any minors under my supervision) am/are in good health and have no medical conditions that would prevent safe participation in farm activities. I understand that Pond View Farm is not responsible for providing medical care due to injury or illness. ENTIRE AGREEMENT This Release and Waiver of Liability constitutes the entire agreement between me and Pond View Farm regarding my visit and supersedes any prior agreements. GOVERNING LAW This agreement shall be governed by the laws of the State of Ohio. SIGNATURE I have read, understood, and voluntarily agree to the terms of this Release and Waiver of Liability. I am signing this agreement freely, without duress, and with full knowledge of its legal consequences.
